Need urgent help on replying to I-485 RFE, I am in a critical situation. I have received an RFE dated 14th May which was mailed by uscis on 30th May and was received by my friend on 8th of June. The deadline to reply to this RFE is 13th of June (30 days from the date of letter) otherwise my application may be denied. The RFE is accompanied by a gold sheet(which needs to be included in the reply) which has my case number, agent working on it and the address where reply has to be sent. My employer is preparing the letter requested in RFE. My friend has received that letter with the gold sheet but it may take some time to reach attorney or my employer who are in the east coast and friend in west coast and I may miss the deadline. Can we use some similar color sheet and photocopy whatever was there on the gold sheet and send it along with the reply rather than waiting for that gold sheet to reach the attorney. I am currently in India and trying to get in touch with my lawyer as well.

Today I received CRIS email that my I485 (and my spouse) has been denied. I am working with same employer since start of my GC process (2003). Year back I switched to EAD after they refused to file H1b extension. Can I still work on EAD? What are my options?

Hi, I just came to know from uscis website that my I140 is denied. I have not received any documents from uscis as my name is in beneficiary. It will goto my employer. Than If he respond than I will know. I am currently on 7th year of h1 extension and having 2 weeks left on my h1. (22 june 2009) Not on project rightnow and have not run payroll since last 6 months. My employer is not responding to any of my emails and phone calls since 1 month. GC Filed: march 2005 in traditional process (not in PERM) EB3 Labor approved : june 2006 I140 filed: Nov 2007 - Denied end of may 2009. 1) What are my options ? 2) Can I use my current approved labor to get extension in new company after h1 transfer? 3) If I transfer my h1 to another company, what about next year h1 extension? if company does not file GC at the time of h1 transfer. does 365 days rule apply in that ?

Pl. help with your precious advice. I got laid off five months back. I kept hunting new job but could not get one. Now I plan to move out of the country. In the circumstances, is my employer who was holding my H1b during termination, liable to give return tickets to my base country ? Can I claim the same after five monthsof my termination since I failed to get any job? What about my family members? Could anyone please advice me on how to claim the unpaid salary from the previous employers. I was working for a company based in Michigan run by an Indian. This person did not pay me my last month salary. He does not pick up his phone or respond to my email. I have all the proof that my client has paid him the money for which I worked but he continue to ignore my request. This guy owes me around 5000 dollars. Any piece of advice would be of great help.

I filed by I 485 application in May 2007. I had two I-140 applications approved at the time of filing 1) I-140 approved based on regular Labor Application applied in 2001 2) I-140 approved based on PERM labor application applied in 2005. Because of the above, I am eligible for earlier Priority Date of OCT 2001 under EB2. Though my PD has been current (for most of time) since 2 years, my I 485 application is not approved. I have filed several service requests, contacted congressman, senator with no result. Each time I got a letter from USCIS saying that they are processing my case and I should wait for another month or two months etc. Recently I went to USCIS field office and officer showed me some pity and explained the situation. here are the details: Before joing my current company, my earlier consulting company filed a I-485 application that was rejected. (I also didn't bother to pursue it at that time as I joined my current company). Now as per officer at the Field office, USCIS somehow assigned my 2001 I-140 approved petition to "old and closed I 485 application" and assigned my 2005 I-140 to my current I 485 application. He told me it was a mistake and somehow it needs to be corrected. He also told me he can't correct from here. Some how I need to contact USCIS and get this fixed. My lawyer says, there is nothing we can do, but wait to get an RFE and then reply. But I have been waiting for a long time with no response. It seems USCIS is NOT even looking my application. I don't know how to contact USCIS and get this fixed. Do I need to write a letter or send a form? I tried calling USCIS main number and they don't have any clue. I appreciate any help from you.
